Rental Terms & Conditions

RENTAL TERMS AND CONDITIONS

1. DEPOSIT: The RENTER shall pay a nonrefundable security deposit of $50.00 ($25 if renting for a single day) prior to receiving rental equipment. This deposit will be returned to the RENTER in full at the termination of this rental, subject to the option of the OWNER to apply it against rental charges and damages. Any amounts refundable to the RENTER shall be paid at the time this Rental is terminated. The security deposit shall not bear interest.

2. The RENTER must return all equipment and accessories by 4:00 PM, or an additional day’s rental fee of $15 will be charged at time of return. If RENTER has agreed to single day usage, machine return time is 24 hours from the time it was picked up. Machines & all additional equipment not returned within the 24 hour rental period will be subject to a $15 fee for each additional day of usage.

3. The RENTER shall keep and maintain the rented equipment during the terms of the rental at his own cost and expense. S/he shall keep the equipment in a good state of repair, normal wear and tear excepted.

4. The RENTER shall pay the OWNER full compensation for replacement and/or repair of any equipment which is not returned because it is lost or stolen or any equipment which is damaged and in need of repair. The OWNER’s invoice for repair is conclusive as to the amount RENTER shall pay under this paragraph for repair of rental equipment. The cost to replace the Brother Innov-is 40 sewing machines is $450.00. This amount shall be due to the OWNER for many machines that are lost, irreparable or not returned.

5. The equipment shall be rented to RENTER and returned to OWNER at the RENTER’s risk, cost and expense. If a periodic rental rate is charged by OWNER, rental charges are billed to the RENTER for each period or portions of the period form the time the equipment is delivered to RENTER until its return. If a term rental rate is charged by OWNER, rental charges are billed to the RENTER for the full term even if the equipment is returned before the end of the term. If the equipment is not returned during or at the end of the term, then the rental charges shall continue on a daily term basis until equipment is returned to OWNER.

6. No allowance will be made for any rented equipment or portion thereof which is claimed not to have been used. Acceptance of returned equipment by OWNER does not constitute a waiver of any of the rights OWNER has under the rental agreement.

7. If the RENTER is in default of any of the terms and conditions of this agreement, the OWNER, and his agents, at the RENTER’s risk, cost and expense reserve the right to charge the RENTER for the full cost of the equipment so it may be replaced.

8. The OWNER makes no warranty of any kind regarding the rented equipment, except that OWNER shall do their best to replace the equipment with identical or similar equipment if the equipment fails to operate in accordance with the manufacturer’s specifications and operation instructions. If equipment fails, it is the RENTERS responsibility to notify the OWNER immediately or a daily rate will still be charged until the equipment is returned.

9. RENTER indemnifies and holds OWNER harmless for any injury or damage done to persons or products that come in contact with rented equipment. OWNER is not liable for any medical expenses or property replacement that is damaged by use of rented equipment.

10. The RENTER shall pay all reasonable attorney and other fees, the expenses and costs incurred by OWNER in protection its rights under this rental agreement and for any action taken OWNER to collect any amounts due the OWNER under this rental agreement.

11. RENTER indemnifies and holds OWNER harmless for all injuries or damage of any kind for repossession and for all consequential and special damages for any claimed breach of warranty.
These terms are accepted by the RENTER upon delivery of the terms to the RENTER or the agent or other representative of RENTER.

Rental Periods:

A One Day rental is a period of 24 hours. Machines not returned within 24 hours from the time the agreement is signed will be charged $15 for an additional day’s use. One day rentals are not available on Saturdays during the off season!
A One Week rental period constitutes 6 days of use (no returns can be made on Sundays during the off season). Machines not returned by 2:00 PM on the 6th day will be charged a $15 fee for each additional day.
A Two Week rental period constitutes 13 days of use. Machines not returned by 2:00 PM on the 13th day will be charged a $15 fee for each additional day.
A Three Week rental period constitutes 19 days of use. Machines not returned by 2:00 PM on the 19th day will be charged a $15 fee for each additional day.
A One Month rental period is 31 days. Machines not returned by 2:00 PM on the 31st day will be charged a $25 fee for each additional day.
